Terms and Conditions / Terms of Engagement

 

Our main target is to allow a long-term relationship with the client, with a proactive attitude and responsive services.

 

Before accepting a case, we carefully review any possible conflict of interest. During the performance of our services, we constantly check if there could be any potential conflict with existing or news clients, in order to take the proper steps to avoid or cease such situation.

 

Once checked the lack of conflict of interest, we agree with the client (and document) how we're going to act on his/her behalf or interest, and what are the objectives that should be achieved, what to avoid, what path should be followed.

 

 

Fees

We establish and communicate a clear fee structure, acording to the nature of the engagement:

- by the hour, which is the usual fee structure

- fixed fees

- capped fees

- monthly retainers

- contingency fees

- or a combination of the above criteria

 

 

Expenses

We define in detail what expenses will be necessary, how we'll be reimbursed by the client and the proceeding to get the client's approval to expenses not covered in the initial forecast. The expenses are invoiced for its original cost, of course.

 

Litigation costs and proceedings are detailed in the proper letter of engagement to be approved in advance by the client.

 

 

Other relevant information

Our office is placed in the center of Barcelona. You can get there in many different ways (bus, metro, taxi). Near our office you'll find several parking facilities.

 

From Barcelona, we serve our clients across Spain (mainly Catalonia, Madrid, the Balearic Islands and Costa del Sol).

As one of our main worries is to create long-term relationships with clients, we try hard to preserve mutual confidence and commitment.

 

As sometimes these goals are difficult to achieve, it is necessary to proceed to transfer the case or even the role as lawyers or tax advisers to someone else. There are also cases of M&A that result in a change of team of advisers, which shouldn't create a major problem. So, we are aware of different circumstances that bring the client and the firm to a situation that, managed wrongfully, would create unnecessary issues that must be avoid.

 

Therefore, we firmly state that the client has the right to terminate the relationship with our firm, which also has the same right. In any case, our professionals will take the proper stakes to allow a soft transition of the case or cases to a new firm.

 

We also keep deep professional relations with Corporate Finance advisors, auditing firms, company agents and other professionals that allow us to better serve our clients' needs.

 

We can assist clients in English, Spanish, Catalan, French or Italian.
